A jury ruled in favor of a medical doctor in a negligence case filed by a Syracuse man who was hurt in a traffic crash when driving home from a sleep study six years ago.
Max and Marlene Evans, Syracuse, filed a civil suit against Elkhart General Hospital and Dr. Muhammad Naeem and accused them of negligence.
Evans underwent a sleep study on March 31, 2006 for six hours at the Elkhart hospital, then after he was released April 1, he was hurt in a traffic crash while driving home. He suffered back and leg injuries.
The case was presented to a jury in a trial last week in Elkhart Circuit Court. Evans was represented by attorneys with the Yoder, Ainlay, Ulmer and Buckingham firm in Goshen.
The hospital and doctor were represented by Ed Murphy, Fort Wayne.
The jury found for the defendants.
“We are disappointed in the result, the outcome,” said attorney John Ulmer, Goshen.
