Special prosecutor won't charge Elkhart County official

A STAFF REPORT THE GOSHEN NEWS

Elkhart County Commissioner Terry Rodino will not face charges after an allegation of sexual assault, prosecutors announced today.

Last year, the Allen County Prosecutor’s Office received a case against Rodino from the Elkhart Police Department. The Elkhart County prosecutor has requested outside review of the case, and Allen County Prosecutor Karen E. Richards agreed to serve as special prosecutor in the investigation.

“The report indicated that a female alleged a sexual assault by Mr. Rodino,” according to a news release this afternoon from the Allen County Prosecutor’s Office. “This office reviewed the investigation and determined that the alleged victim admitted to prior sexual contact with Mr. Rodino. Mr. Rodino also acknowledged some contact of a sexual nature.

“However, this conduct has no connection to his duties as County Commissioner,” the statement continued. “Based on the totality of the circumstances, we do no believe we can prove sexual assault beyond a reasonable doubt. Therefore, prosecution of this case is declined.”

    Access to the CVS at 410 S. Main St. in Goshen could soon be easier for those with disabilities following a ruling by the Goshen Plan Commission Tuesday afternoon.
    During their meeting Tuesday, Goshen Plan Commission members gave their blessing to a request by CVS Pharmacy and State Permits Inc. for a major change to the CVS Planned Unit Development that seeks to reconfigure the north portion of the parking lot to increase the overall Americans with Disabilities Act accessibility of the site. The final site plan for the PUD was also approved by the commission Tuesday, and the request will now be forwarded on to the Goshen City Council with a favorable recommendation.
