Middlebury council approves $8.5 million bonding for sewer project

MIDDLEBURY — On first reading, the Middlebury Town Council voted Monday to issue revenue bonds for a proposed sewer improvement project with an estimated price tag of $8.5 million.

If the project is approved, the bonds would be issued for the Middlebury East District, according to town attorney Craig Buche.  The second and final reading of the proposed ordinance to authorize issuance of the bonds will be held at the council’s next meeting at 6 p.m. July 2.

Council members also hired H. J. Umbaugh & Associates of Plymouth and Ice Miller, LLP of Indianapolis to provide financial services and bond counsel services, respectively, to the town of Middlebury for the sewage works revenue bonds.  Town Manager Mark Salee said that Umbaugh would be paid approximately $32,000, while Ice Miller would be compensated up to $30,000 for their services.

The project would be the town’s first wastewater treatment plant and lift station upgrade in 14 years.

Salee said that the treatment plant’s capacity and efficiency would be increased and five lift stations upgraded.

At the May 21 meeting, the council named an authorized representative for a state revolving fund loan and accepted the preliminary engineering report for the project.

Groundbreaking is planned for spring 2013, and the project could be finished by the end of 2014, Salee said.

 In other business, the council:

• Introduced a proposed annexation ordinance for Phase II of the Villas of River Park, located off of East Warren Street/Elkhart C.R. 16, and adopted a fiscal plan for provision of municipal services. The goal is to annex the area by next January.

• Hired Wightman-Petrie, Inc. of Elkhart to provide engineering services for Middlebury’s 2012 street projects for $25,700.

• Voted to allow special summer sprinkling rates for lawns for this month due to the current extremely dry conditions.

• Approved an amendment to the town’s employee handbook to comply with a new Indiana law regulating superior-subordinate relationships among town employees and contractors when family members are involved.

• Salee introduced a proposed subjective-type noise ordinance for council review, but a section needs to be added to allow the use of engine, or air, brakes on semi tractor trailers.

• Salee also announced that a burning ban is in effect for all of Elkhart County until at least 9 a.m. Friday due to dry conditions.
